Tenant information Form

In a recent review of the association leasing restrictions and files, it has come to our attention that homeowners may not be in compliance with the rental restrictions. For your convenience we have inserted the Rental information from your governing documents below.

    1. Leases must be for at least six months. This also means that no AirBnB rentals are allowed within the community.
    2. Rental information and lease terms are required to be on file with the association within 10 days after the effective date of the lease. According to the governing documents, a lease needs to be on file with the association. However, per a recent law that passed, the association cannot request this directly from you. Therefore, we have created the attached tenant form that the association can request from you to fill out and return.

"Rentals"

Nothing in this Declaration will prevent the rental of any Lot and the Improvements thereon by the Owner thereof for residential purposes; provided that:

    • All rentals must be for minimum terms of at least six (6) months.
    • No portion of a Lot (other than the entire Lot) may be rented. All leases shall be in writing.
    • Notice of any lease, together with such additional information as may be required by the Board, will be remitted to the Association by the Owner on or before the expiration of ten (10) days after the effective date of the lease.
    • Each lease must provide, or be deemed to provide, that the Board shall have the right to terminate the lease upon default by the tenant in observing any provisions of the Restrictions.
    • Regardless of whether or not expressed in the applicable lease, all Owners shall be jointly and severally liable with the tenants of such Lot to the Association for any amount which is required by the Association to effect such repairs or to pay any claim for any injury or damage to property caused by the negligence of the tenant of such Lot or for the acts or omissions of the tenant(s) of such Lot which constitute a violation of, or non-compliance with, the provisions of the Documents.
    • All leases shall comply with and be subject to the provisions of the Restrictions and the provisions of same shall be deemed expressly incorporated into any lease of a Lot.
    • This Section 2.04 shall also apply to assignments and renewals of leases. The Board shall have the express authority to promulgate additional leasing or occupancy rules, including penalties for infractions thereof.

    3. Signage
      o One (1) 18" x 24" temporary "For Sale" or "For Lease" sign may be placed in a window of the Dwelling on the Lot. The sign must be removed within two (2) business days following the sale or lease of the Lot. However, the Board has agreed to allow the signage to be placed in your front yard.
